    Property management—what are its actual responsibilities?

    The work of property management and its tasks are diverse, complex, and often not entirely transparent. However, if you are acting as the owner, buyer, or seller of a property, you should have a clear understanding of the responsibilities involved. As a real estate agent based in Munich, we often deal with property management and serve as your interface to the relevant property managers.

    What does a property management company do? Key responsibilities

    As service providers, property management companies perform a wide range of tasks on behalf of owners or owners' associations. In both rental and condominium management, the long-term preservation of a property's value is the primary focus. In addition, managers are responsible for ensuring that organizational, financial, and legal processes relating to a property run smoothly.
    The following tasks are not precisely defined by law. Contractual provisions and clear agreements are therefore particularly important. We present some key areas of activity below.

    Commercial tasks of property management

    To ensure that rental income, operating costs, and billing are managed efficiently, some of your property manager's tasks are of a commercial nature. These include, for example:

    • Preparation of transparent operating cost statements in accordance with § 2 BetrKV: The utility bill must be prepared for each rental property in a legally compliant manner, on time, and using modern software. By taking an accurate approach, administrations can avoid disputes. Both tenants and owners benefit from full cost transparency.
    • Collection of rent, monitoring of payments, and dunning: In addition to these daily rent collection tasks, the property management company initiates legal action if necessary and documents everything properly.
    • Business plan and reserves: In the case of condominium owners' associations, the legally required annual planning (§ 28 WEG), including operating costs, reserves, and investments, serves as the basis for numerous owner decisions. A structured financial plan provides security for future measures and investments. In this case, it is also one of the tasks of a property management company.

    Overall, by performing these tasks, the property management company should help to ensure the profitability of your property and create financial transparency for all parties.

    Technical tasks of property management

    In order to maintain the structural condition of a property in the long term, the property management company takes on a wide range of technical tasks. These include, among other things:

    • Coordination of maintenance and repairs: Regular inspection of technical systems—such as heating systems, elevators, or fire protection—is an important issue. Property management companies do not usually perform these tasks themselves, but instead commission specialist companies, document maintenance intervals, and ensure compliance with legal requirements.
    • Damage assessment and defect processing: In the event of technical problems, the administration records the damage, informs you as the owner or tenant, and initiates the necessary measures. Experts ensure that defects are tracked in a structured manner—from the initial report to acceptance by tradespeople.
    • Construction work and modernization: For larger projects, such as renovations or energy efficiency improvements, the property management company obtains quotes, oversees the work, and informs those involved about the schedule and costs. Here, too, clear communication with everyone involved is essential.

    Legal duties of property management

    In addition, the property management company ensures compliance with important legal regulations—such as fire safety, traffic safety, and data protection. It handles correspondence with authorities, organizes notifications and approvals, and relieves owners of the burden through structured communication. However, legal representation in the narrower sense is provided exclusively by a lawyer—the property management company ensures that regulations are implemented correctly.

    Differences between the tasks of WEG and traditional rental management

    Depending on the type of ownership and management mandate, you should also bear in mind that property management companies and their tasks can vary significantly. While the homeowners' association focuses on common property, rental management takes care of the individual property of individual owners—especially in rented properties.

    WEG administration:

    • Management of common property

    • Preparation of the business plan and annual accounts

    Rental management:

    • Management of separately owned property (apartment, commercial unit)

    How do real estate agents work in comparison to property management companies?

    Unlike a property manager, a real estate agent has different contractual obligations, which can also be very individual. They only come into play when you want to sell a property, for example, in Munich. They can also provide comprehensive support with new rentals. A real estate agent:

    • provides comprehensive advice on sales and rentals
    • determines a market-driven sales price or rental amount with you
    • creates the marketing strategy and exposés
    • specifically addresses potential buyers or renters

    Provision of sales-related documents

    To ensure that the sale of your property is legally compliant, your real estate agent will need documents such as any declarations of division, the reserve balance, minutes of owners' meetings, or the economic plan. The management company will provide these documents and clarify any queries if necessary. If the property management company fails to fulfill this task, the sale may be delayed or jeopardized.

    Vote on renovation and refurbishment

    Prospective buyers often ask about planned maintenance or recent renovations. The property management company provides reliable information and evidence. Real estate agents use this to present your property and provide transparent information about costs or special charges.     Clarification of administrator approvals for sales

    Many declarations of division stipulate that the sale of separate property requires the consent of the property management company. For this reason, real estate agents must occasionally clarify at an early stage whether such a clause exists. The property management company then has the task of checking all the buyer's documents and granting consent, provided there are no important reasons to the contrary (Section 12 WEG).

    Coordination of viewings and key access

    In many rented or shared properties, access to the property is regulated. Since real estate agents want to conduct viewings or appraisers plan visits when selling or renting, this must be coordinated with the property management company. They inform tenants and caretakers and organize access if necessary. Smooth coordination saves time and avoids misunderstandings.

    Both parties have different priorities.     What are the main responsibilities of a property management company for my condominium?

    There are two areas of property management: WEG management takes care of the common property of a residential complex, i.e., stairwells, roof, facade, and communal facilities, while rental management takes care of the individual property of individual owners. However, the term property management often encompasses both. Thus, property management is generally responsible for the organizational, commercial, and technical management of a property.

    What is the difference between a property manager and a real estate agent?

    A professional real estate agent primarily takes care of marketing, i.e., the sale or rental of your property. Property management tasks are different, as service providers manage the ongoing maintenance and administration of a property—such as maintenance, utility billing, or communication with tenants and authorities.

    Does a real estate agent have to work with the property management company?

    Yes, especially when selling or re-letting within a condominium association, coordination with the property management company is essential for our brokers. This involves, for example, the exchange of documents, the administrator's approval, or queries regarding reserves and construction measures.

    Is the utility bill part of the property management company's responsibilities?

    Yes, the operating costs statement falls within the scope of property management. However, the real estate agent can request these documents and include them in the marketing of a condominium as a basis for decision-making for potential buyers or tenants. In the area of condominium management, the administrator also prepares the annual statement for the common property.

    Can a real estate agent also take on property management tasks?

    No, legally and organizationally, the tasks are clearly separated. Brokers are not permitted to take on administrative tasks, such as rent collection or technical property management. However, cooperation is possible and sensible. If brokers and property managers work well together in their tasks, this makes selling and renting much easier.
